Preamble

These general conditions of sale are written in French and express the obligations, the rights of the Customer and the company LUXURY CHIC. In this sense, the Customer is deemed to accept in full the provisions of these conditions. LUXURY CHIC undertakes reciprocally to respect the obligations incumbent upon it in the context of these presents. 

 Will be called a "Customer", anyone wishing to trade with the company LUXURY CHIC respecting these terms and conditions. Each Order made by a Customer under the conditions provided herein will be hereinafter referred to as "Order". The companies that LUXURY CHIC uses to transport the Products to the Customer are here called "Carriers". Customer Service can be reached via the contact form on the website. The response time can not be guaranteed.

 

Article 1: object

These terms and conditions are intended to define the rights and obligations of the parties in connection with the online sale of products and services offered by the company LUXURY CHIC to the Customer.

 

Article 2 - Contract

The validation of the order at the end of the order process marks the conclusion of the contract between the Customer and LUXURY CHIC. In accordance with the law of March 13, 2000 and the law on confidence for the digital economy of June 21, 2004, any validated purchase order constitutes irrevocable acceptance like a handwritten signature that can only be challenged if within the limits provided for in these terms and conditions. 

 The general conditions of sale are concluded for the duration necessary for the supply of the subscribed products and services, until the extinction of their guarantees. 

 Contractual information about the order will be confirmed by email. LUXURY CHIC recommends that the customer keep his order confirmation email or print it.However, will be considered legal proof of communications, orders and payments between the parties, the filing of purchase orders and invoices in the computer systems of the company LUXURY CHIC.  

 The products ordered on the site www.yvesenzo.fr  by the customers are governed by the general conditions of sale on line on the date of this said order.  

LUXURY CHIC reserves the right to modify its general conditions of sale at any time.

 

Article 3 - Products

Products offered by the site www.yvesenzo.fr   comply with French legislation and standards applicable in France.

The site www.yvesenzo.fr   endeavors to present the essential characteristics of the products on the product's product sheets. The information presented by the site www.yvesenzo.fr   have been communicated by the Suppliers.

Descriptions (photographs, texts, graphics, information and features) illustrating the products presented are indicative.

In case of error of description (photographs, texts, graphics, information or characteristics) on a product, the responsibility of the company LUXURY CHIC can not be engaged.

In case of misdescription, the Customer will not automatically obtain the right to return the product with reimbursement of shipping costs. It will be up to the company LUXURY CHIC to judge whether this error justifies the reimbursement of the shipping costs paid by the Customer.

LUXURY CHIC undertakes to honor orders received within the limits of available stocks.  

In the absence of availability of the Product, in no case the responsibility of the company LUXURY CHIC can not be engaged, nor to open right to damages and interests for the Customer. However, the company LUXURY CHIC undertakes to inform the Customer as soon as possible and to offer a similar Product in the same price and feature level or a refund.

If the Customer opts for a refund, the company LUXURY CHIC will make every effort to reimburse the Customer within 30 days from the date on which the company LUXURY CHIC informed the customer of the unavailability of the product. If this period is exceeded for reasons beyond its control, LUXURY CHIC can not be sued by the Client. 

 Most Products sold on the site www.yvesenzo.fr   are stored in its warehouses. However, some Products are stored at Suppliers. For these Products, the availability period corresponds to the delivery of the Supplier's Warehouse Product to that of LUXURY CHIC. In this case, the delivery time at the Customer is the period of availability to which must be added the delivery time indicated on the Site.  

Any non-respect of the deadlines attributable to the fault of the Supplier or the Carriers will in no case engage the responsibility of the company LUXURY CHIC.

 

  Article 4 - Prices and Taxes

The prices of the Products sold on the site are indicated in Euros Excluding Tax, excluding participation in shipping, warranty, ancillary services and are valid as long as they are present on the product description. If the price of the same product is wrong on another site site, it is the price indicated on the descriptive sheet that is authentic.

For all sales sent to professionals in the European Union and benefiting from an intra-community VAT number, it is the price excluding taxes that is applied. For all other countries, it is the price excluding taxes that is applied, as well as for DOM-TOM. You must inform yourself of the customs fees you will have to pay when receiving the goods.   Import taxes are to be paid by the final recipient upon arrival of the goods. 

 LUXURY CHIC reserves the right to change prices at any time but the products will be billed based on the rates in effect at the time of registration of orders, subject to availability on that date.

LUXURY CHIC can not be held responsible for fluctuations in the indicative public price. These will in no case entitle the Customer to return his Product outside the conditions and deadlines for returns provided in Article 8 below.

The company LUXURY CHIC can not be blamed in case of fluctuations in the sale price and any price differences will not be refunded in any case.  

 All prices are subject to obvious typographical error. If an error should occur, the company LUXURY CHIC will contact the Customer to warn of the error made by our services and remind him that the order will be charged to the conditions corrected. In case of refusal of the new conditions, the Customer will be free to cancel the corrected order without penalty.

 

Article 5 - Order

Only people legally able to take out contracts for the goods and services offered on the site can order on the site www.yvesenzo.fr

Orders are only made on the site www.yvesenzo.fr. The Customer does not have the possibility to carry out his order by telephone.

When placing the Order, the Customer guarantees to have full legal capacity to adhere to these terms and conditions and thus conclude this contract.

The Customer warrants that he is fully entitled to use the credit card he uses and that the latter gives access to sufficient funds to cover all the costs necessary for the payment of the order. 

 When ordering, the Customer agrees to provide the information requested and agrees on the veracity of the latter:

Type of credit card, card number and expiry date of the card

Any Customer validly registered on the site www.yvesenzo.fr will be engaged by any order that required the use of the email address and personal password of the said Customer (subject to the right of withdrawal and return defined herein) .  

The Customer must verify all information entered during the order (product ordered, delivery address, billing address, phone number ...).

If after validation of his order the customer realizes the need to modify certain data, he can do it by contacting the customer service by the contact form present in the customer account within 10 hours so that the latter can satisfy its request at best (only the correction of the email address of the customer is possible directly on the site www.yvesenzo.fr but it will be recorded for the next order).  

The company LUXURY CHIC can not be held responsible for any data entry errors and consequences in terms of delay or delivery error. Thus, if the delivery can not take place because of an error of seizure by the Customer, the forwarding costs will be charged to the customer and delivery times will be strongly delayed. 

 The site www.yvesenzo.fr will send a confirmation email after validation of the order to summarize the contractual information.

When the Customer's Order is then validated by the Services of the site www.yvesenzo.fr according to the payment validation procedures described in Article 6 below, the Customer is then notified by email of the shipment of his order. 

 Orders are processed in the order in which they are actually received. The company   LUXURY CHIC undertakes to process all orders, within the limits of available stocks.  

In case of unavailability of the ordered product, the Customer will be informed at the earliest and will have the possibility to cancel his order.

The customer can then request a refund of the amount of the sums paid.

LUXURY CHIC will make every effort to reimburse the Customer within 30 days of the date of unavailability. If this period is exceeded for reasons of force majeure by the client, unpredictable and insurmountable by a third party, LUXURY CHIC can not be pursued by the Customer.

Deliveries are made only according to the availability and in the order of arrival of the orders and can be made in a total or partial way.  

 The company LUXURY CHIC can not be held liable for the non-performance of the contract in case of out of stock or unavailability of the product, force majeure, disruption or total or partial strike including postal services and means of transport, communications, flooding , fire, and in case of manifest error.

LUXURY CHIC can not be held liable to a Customer or a third party for any indirect damage, loss of profit or turnover that has occurred in any way whatsoever, even if such damage or loss or damage was foreseeable by LUXURY CHIC, or if its contingency had been brought to its attention.

 

Article 6 - Payment

www.yvesenzo.fr   has adopted the SSL encryption method, which ensures the reliability of exchanges and transactions by encrypting at the time of their capture all banking details of Customers, which are thus transmitted directly to the CM-CIC Bank, via a secure connection, without passing through the Site   www.yvesenzo.fr .

 

So any suspicious order or   fraudulent   blocked so that we can check his credibility.  In this case, an e-mail informing you   this action will be sent and your order will remain blocked until receipt of proof of identity.

The payment validation will be considered effective after confirmation of the agreement of the payment centers and acceptance of payment by LUXURY CHIC. Only the validation of payment allows the shipment of the package to the delivery address chosen by the Customer.

 Some validations will be done directly, that is to say without prior verification procedure. However, in order to limit the risk of fraud and thus protect the interests of its Clients, LUXURY CHIC is sometimes required to carry out checks on the validity of payments made by credit card on the site.

 Customers are notified by email of supporting documents (a photocopy readable double-sided of a piece of identification and proof of address) to send in order to obtain the final validation of their order.

 At the end of this possible control:

The company LUXURY CHIC reserves the right to accept the order, and a fortiori to validate the payment.

The company LUXURY CHIC may in case of non receipt of these supporting documents within 48 hours refuse the validation of the payment.

The company LUXURY CHIC can in case of receipt of documents deemed non-compliant proceed to refund the said order by the credit of the bank account that was debited when ordering.

If the control can not take place within 48 hours from the date of the order by the fault of the Customer, the order can not be honored and will be canceled by the company LUXURY CHIC who gives himself the right to request said documents to obtain the reimbursement of his order.

 The billing of the Customer usually occurs within 24 hours from the day of payment validation. In case of withdrawal by the Customer beyond this period of 24 hours, the shipping costs can not be refunded and will remain his responsibility.

LUXURY CHIC never has access to confidential information relating to the means of payment. This is why the Customer's bank details are requested for each order.  

 In fact, only the CM-CIC bank has confidential information (card number, validity date) that is inaccessible by a third party.  


 The customer has the opportunity to pay his order online in several ways:

Online payment by credit card (Carte Bleue, VISA, Eurocard / Mastercard or other means of payment valid on the site). In case of online payment by credit card, the Customer is required to provide the type of credit card, the credit card number, the expiry date and the cryptogram. It guarantees that it is fully entitled to use the card and that the card gives access to sufficient funds to cover all the costs resulting from the ordering of LUXURY CHIC products.

Payment by bank check issued by a bank domiciled in metropolitan France whose amount by check does not exceed 5000 euros. The Customer then has 48 hours to send his check - postmark as proof. In the absence of receipt of a check from him after this 48h period, his order will be automatically canceled. The company LUXURY CHIC declines any responsibility for loss of the payment, delay of treatment of the payment in case of sending the payment by means other than A / R mail or simple mail by the Post office. In the absence of authorization to pay by check, the order is not made available to the customer and another method of payment is requested. The company LUXURY CHIC reserves the right not to respond to the order of a customer for whom problems have already occurred. The company LUXURY CHIC retains ownership of the items delivered until the full payment of the price by the customer.

Payment by transfer. The Customer then has 24 hours to send the copy of the transfer - stamp of the bank as proof. In the absence of receipt of the transfer from him past the 72h period, his order will be automatically canceled.

Cash settlement up to € 1,000 incl.

LUXURY CHIC reserves the right to suspend or close the account of a Client who contravenes the provisions of these general terms and conditions.  

Anyone whose account has been suspended or closed can not order on the site www.yvesenzo.fr without the authorization of the services of the company LUXURY CHIC beforehand.  

The LUXURY CHIC company reserves the right to refuse to make a delivery or to honor an order from a Customer who has not fully paid a previous order or with whom a payment dispute is being administered. .

The company LUXURY CHIC reserves the property of the products subject of the order until payment and full collection of the selling price. Under no circumstances may payments be suspended or be subject to any compensation without our prior written consent.  

 The Customer's bill is available directly on the Site in the "my account" section accessible from the home page. By entering his email address and his password on the site   www.yvesenzo.fr   the Customer may print the invoice relating to his Order.

 

Article 7 - Delivery

The products will necessarily included the recipient and   the address indicated on the invoice, this information is provided by the Customer when entering information during the order. Therefore, the company LUXURY CHIC asks the Customer to ensure the accuracy of the information he could provide for the delivery of his order.  

 

For all deliveries outside France, the goods can not be removed by the customer.

 

Several delivery methods are available to customers when ordering   :

For Metropolitan France:

The following carriers will be responsible for the expeditions   :   GLS, DPD, OCS, COLISSIMO , TNT / FEDEX .

 

For Europe   :

The following carriers will be responsible for the expeditions   :   GLS, DPD, COLISSIMO, C HRONOPOST.

 

For Overseas (DOM- TOM )   :

The following carriers will be responsible for the expeditions   :   UPS, COLISSIMO .

 

For the international   :

The following carriers will be responsible for the expeditions   :   OCS, COLISSIMO .

 

For all destinations

Your Carrier   : The Customer must provide the details of the carrier and bears all the costs at his expense.

 

At the time of the seizure of his order, the Customer chooses the mode of delivery proposed on the commercial site according to the place of the delivery.

Shipping costs are calculated based on the volumetric weight of the order and the delivery service chosen.
